MorgsMTB Coaching — Terms & Conditions & Risk Disclosure
Your Safety
At MorgsMTB, your safety is our priority. Mountain biking is an inherently physical and dynamic activity, and while we take reasonable steps to manage risks and create a safe learning environment, not all risks can be eliminated.
Before participating in a MorgsMTB coaching session, please read and understand the following risk disclosure and terms.
Risk Disclosure
Mountain biking involves riding over natural and purpose-built terrain that can be uneven, unpredictable and challenging. Depending on the session and your ability, this may include rocks, roots, steep terrain, loose surfaces, berms, jumps, drops, obstacles and other technical features.
Mountain biking also involves the possibility of falls, collisions and loss of control. Risks may include, but are not limited to:
Cuts, grazes, abrasions and bruising
Sprains, strains and soft-tissue injuries
Fractures or dislocations
Head, neck or spinal injuries
Concussion or other serious injury
Injury resulting from collisions with another person, bike or object
Mechanical or equipment failure
Changes in weather, trail or ground conditions
Serious injury, permanent disability or, in extreme circumstances, death.
Your Responsibilities
To help manage these risks, you agree to:
Follow the instructions and safety guidance provided by your coach.
Ride within your own ability and comfort level. You are encouraged to communicate with your coach if something feels beyond your current ability or confidence.
Tell your coach about anything that may affect your ability to participate safely, including relevant injuries, limitations, fatigue or other circumstances that could affect your riding.
Use appropriate safety equipment, including a properly fitted and approved helmet. Additional protective equipment may be recommended depending on the activity.
Ensure your bike is in a safe and suitable condition for the session. Your coach will inspect your bike and may recommend that a bike or component is not suitable for the planned activity.
Speak up and ask questions. If you do not understand an instruction, technique or activity, please let your coach know.
Coaching & Session Management
Your coach may modify, change or stop an activity if they believe that the terrain, weather, equipment, rider ability, fatigue or another factor creates an unacceptable level of risk.
Progression is based on your individual ability and readiness. You will never be expected to attempt a feature or activity simply because it is part of the planned session.
Our goal is to challenge you appropriately while maintaining a safe, positive and supportive learning environment.
Fitness & Readiness
You are responsible for arriving at your session reasonably prepared to participate.
Please consider your fitness, hydration, nutrition, fatigue and mental readiness before riding. If you are feeling unwell, excessively fatigued or otherwise unable to participate safely, tell your coach before or during the session.
If you have any concerns about whether you are physically capable of participating, seek appropriate medical advice before undertaking the activity.
Alcohol, Drugs & Impairment
For your safety and the safety of others, you must not participate in a MorgsMTB coaching session while under the influence of alcohol, recreational drugs or any substance that may impair your judgement, coordination, reaction time or ability to participate safely.
Alcohol or recreational drugs must not be consumed before or during your coaching session.
If your coach believes you are impaired or otherwise not fit to participate safely, they may refuse or stop your participation in the session.
In these circumstances, the session may be treated as a participant cancellation and the applicable cancellation terms will apply.
If you are taking prescribed medication that may affect your ability to safely participate, you should discuss this with your medical professional before attending your session and inform your coach of any relevant safety considerations.
Emergencies & First Aid
Mountain biking takes place in environments where access to emergency services may sometimes be delayed.
MorgsMTB coaches will take reasonable steps to respond to incidents and seek appropriate assistance where required. This may include providing first aid within the coach's level of training and contacting emergency services.
Participants should understand that emergency response times and access to medical assistance can vary depending on the location and circumstances of an incident.
Terms & Conditions
By booking and participating in a MorgsMTB coaching session, you acknowledge that you have read and understood this risk disclosure and agree to follow the reasonable instructions of your coach.
You understand that mountain biking carries inherent risks and that participation involves voluntarily accepting those risks.
Nothing in these terms is intended to exclude, restrict or modify any rights or protections you may have under applicable New Zealand law.
If you have any questions about the risks involved, your session, equipment or your ability to participate, please speak with your coach before starting.
MorgsMTB Coaching — Booking Terms
1. Booking & Payment
Your coaching session is confirmed once payment has been received.
Please arrive on time and ready to ride. If you arrive late, the session may need to be shortened so that it can finish at the scheduled time.
2. Cancelling or Rescheduling Your Session
We understand that plans can change.
More than 48 hours' notice
If you need to cancel or reschedule, please provide at least 48 hours' notice.
You can choose to:
Reschedule your session to another available date; or
Receive a refund of your booking payment.
Less than 48 hours' notice
Cancellations or rescheduling requests made less than 48 hours before your session may be subject to the loss of your booking payment.
MorgsMTB may use discretion in exceptional circumstances.
No-show
If you do not attend your scheduled session and have not contacted MorgsMTB, the session will be considered a no-show and the booking payment will not be refunded.
3. Weather & Trail Conditions
Mountain biking is weather and trail-condition dependent.
If weather or trail conditions are considered unsuitable or unsafe, MorgsMTB may postpone, reschedule or modify the session.
Where MorgsMTB cancels a session due to unsafe conditions, you will be offered the option to:
Reschedule your session; or
Receive a full refund.
We will make this decision with safety as the priority and, where possible, provide as much notice as reasonably practicable.
4. Coach Cancellation
Occasionally, a session may need to be cancelled or rescheduled due to coach illness, injury, an emergency or circumstances outside our reasonable control.
If MorgsMTB needs to cancel your session, you will be offered a suitable alternative date or a full refund.
5. Bike & Equipment
Participants are responsible for bringing a suitable, safe and appropriately maintained mountain bike and the required safety equipment.
Your coach may identify a safety concern with your bike or equipment before or during the session.
If your bike or equipment is considered unsuitable or unsafe for the planned activity, your coach may modify the session or, where necessary, stop the session.
Where the session cannot reasonably proceed because the participant's equipment is unsuitable, the normal cancellation terms may apply.
6. Participant Fitness & Ability
Participants are expected to arrive fit and prepared to participate in the planned activity.
If your coach believes that continuing the session presents an unacceptable risk due to fatigue, illness, impairment, behaviour, equipment or another factor, they may modify or stop the session.
No refund is automatically provided where a session is stopped because a participant is unable or unwilling to safely participate.
7. Progression & Coaching
MorgsMTB coaching is tailored to the individual rider.
Your coach will provide guidance, demonstrations and appropriate progression, but you are not required to attempt any skill, feature or activity that you are uncomfortable with.
Likewise, your coach may decide that a particular skill or feature is not appropriate for you at that time.
The aim is to develop your skills and confidence progressively, rather than simply ticking off features.
8. Children & Young Riders
Participants under 18 must have the appropriate consent from a parent or legal guardian before participating.
A parent or guardian may be required to remain present during the session depending on the participant's age, the activity and the requirements of the venue or coaching session.
9. Photography & Video
MorgsMTB may use photographs or video recorded during coaching sessions for coaching, educational or promotional purposes.
Where required, separate consent will be obtained.
You may decline permission for your image or riding footage to be used for promotional purposes without affecting your ability to participate in coaching.
10. Changes to Your Booking
If you need to make changes to your booking, please contact MorgsMTB as soon as possible.
We will always try to accommodate reasonable requests, subject to coach availability, venue availability and the applicable cancellation terms.
